Supplier Categories Exempt from Standard Insurance Requirements

Summary: Learn which categories of suppliers are exempt from the Standard Insurance Requirements.

Important: Never waive workers' compensation coverage for any supplier that has employees. Confirm that a supplier is a sole proprietor or partnership without employees prior to waiving the requirement for workers' compensation coverage.

The following supplier categories have been determined to be exempt, based on the activity. No individual supplier is automatically exempt for all possible activities, because the supplier may offer some standard or high-risk goods or services.

Miscellaneous Exempt Categories

  Choreographers Models for art classes
  Clothing repair and tailoring Note-takers
  Costumers Painters: artwork only, no ladders, no scaffolding
  Event setup (chairs only) Proofreaders
  Interpreters (including American Sign Language) Tennis Referees
  Makeup artists – face painting Translators

Knowledge Workers – Speaking and Listening Type Engagements

The following categories of suppliers must meet criteria 1-6 provided below.
(Suppliers that do not qualify for an exemption must meet standard UC Insurance requirements.)

  Coaches (non-athletic) Lecturers
  Facilitators Speakers
  Group leaders Team Building Trainers/Facilitators
  Instructors Trainers (non-athletic)
  1. Engagement takes place on UC property.
  2. The activity is primarily classroom-type discussion. For example, no team building exercises that involve physical activity beyond everyday activities. Coaches and Trainers are in knowledge-based fields and not in fields involving physical activity.
  3. No field trips or driving.
  4. No labs or use of hazardous materials.
  5. Use of UC equipment only allowed with oversight by UC employees.
  6. For any topics or events likely to generate public controversy or protest additional risk management precautions may be necessary. (For example, providing security at an event.)

Performers

The following categories of suppliers must meet criteria 1-7 provided below.
(Suppliers that do not qualify for an exemption must meet standard UC Insurance requirements.)

  Actors (live performances only) Disc Jockeys
  Dancers (as entertainment, not as instructors) Musicians
  1. Performance takes place on UC property.
  2. UC employees are responsible for set-up, use and tear down of all UC equipment, including sound systems and lighting.
  3. All stage and seating set-up is the responsibility of UC employees.
  4. The UC sponsoring department is responsible for evaluating the need for security for the event. As necessary, the UC sponsoring department will maintain, or separately contract for, security for the event.
  5. With the exception of dancing, the audience is in the role of spectator and not participant.
  6. For any dances or events involving large audiences then other risk management precautions may be necessary. (For example, providing security at an event.)
  7. Events may not involve productions with special effects. Risk Services must review special effects details prior to waiving the insurance requirements.

United States Federal Government Contracts

  1. Always include indemnification language in the purchase order and contract.
  2. Any contract with the United States Federal Government can be silent on (i.e. omit) the insurance requirements.
